The Problem of Liability for damages caused by AI systems
Marta Giuca obtained her PhD in criminal law from the University of Catania in October 2022. She is currently a Marie Skolodowska/EUTOPIA-SIF post-doctoral researcher at CY Cergy Paris Université and hosted by the CESDIP research centre.
The legal issues involving artificial intelligence systems are manifold. Crucial appears to be the attribution of liability when damage occurs during the use of an AI system. Existing rules on product liability may be insufficient because of the characteristics of AI systems, such as their opacity and self-learning capacity. These properties of AI systems prompt questions about the need to introduce new rules in response to the responsibility gap problem.
