The regulatory power of the state, crises, tensions and transformations

The regulatory power of the state, which is not limited to specific sectors, seems to be under severe strain today in a context of crises and structural transformations. On the one hand, there is a growing demand for regulation. On the other hand, there is a context of interdependence marked by multiple constraints: international and regional commitments, the rise of private and transnational actors, the questioning of the democratic legitimacy of public action, global economic, health, climate and energy crises, etc. These dynamics are redefining the relationships between the state, the law, and private and international actors. They bring tensions with the regulatory power of the state to the fore. The question is therefore no longer just one of regulation itself, but also of the state's normative room for action: to which extent and by what means can it still regulate within an increasingly intertwined legal framework?
This young researchers' day aims to examine the conditions under which the state exercises its regulatory powers in contemporary legal systems and the scope for action available to states in this area.
